including an oakland rapper. officers say a picture of 26-year-old ammar harris will be on billboards across southern nevada and include the southeastern part of the u.s. where harris once lived. he shot oakland rapper kenny "clutch" cherry. the shooting caused cherry to lose control of the maserati he was driving and crash into a taxi causing the taxi to explode killing the driver and his passenger. investigators in walnut creek pinpointing the cause of an overnight fire at an elderly care home. that blaze started just after 8:00 last night at the care home. early reports suggesting it ignited on a kitchen stove which then engulfed nearby cabinets. firefighters arrived and they were able to knock down those flames before it spread to other rooms in the home. an elderly person living inside that home was taken to the hospital for smoke inhalation.

five others are now doing fine. they are now staying at other care homes. >> san jose city council will take a look at plans to revitalize the city's japan town. it's a project that's been years in the making and not without a few bumps in the road. "today in the bay's" bob redell live in san jose with what's involved with those new plans. good morning, bob. >> reporter: good morning to you, laura. it all centers on this five to six acre parcel of land that's right here in the heart of japan town. a spot that the city has wanted to re-vitalize for some time. years ago when we were out there as archaeologist excavated artifacts from that era and then this became the city's corporation yard but for the past several years it's sat dormant. dead concrete patch as you can see in the middle of what is a usually vibrant community. today san jose city council will decide whether or not to approve the basic redevelopment plans for this site and to give permission for staff to continue talks with a developer. the developer is williams and

dane development. they would like to build six buildings on here that would house 600 apartment units, retail space, green space for events like farmer's market and then what they call a center for the arts that would host local groups like the japanese drum group. >> this is a very special place. one of three surviving japan towns in the state of california. we know we have to get this right and it has to be right and not just for the developer or for the city but right by the community. >> reporter: it is taking years to get this right. years ago the developer seemed ready to build 12 story apartment buildings. the community was against it. they thought it wouldn't fit in because of the height and then the recession hit so the developer pulled out. it looks like they are trying to get back in and today if city council approves, it might happen sometime down the line sooner rather than later. reporting live in downtown san jose, bob redell, "today in the

welcome back on a tuesday morning. a look at the south bay spanning over san jose. the sun slowly starting to illuminate the skies out there which are going to be beautiful today as temperatures keep rising. christina loren along in a few to tell us about that. 5:11 right now. hewlett packard ceo meg whitman joined a group of republicans breaking from the party to support gay marriage. scott mcgrew says she's been hard to pin down on this issue. >> she has. when whitman game ceo of ebay way back in 1998, which in the gay marriage issue was an aeon going, whitman was one of the first executives to support benefits for domestic partners. her views changed. they marched far to the right

when she ran for governor of california as a republican supporting prop 8, which defined marriage as between a man and a woman. now she has joined a number of republicans in filing a friend of the court brief to the supreme court which is considering whether to strike down prop 8. she supports that idea. now, that brief was also signed by former president george w. bush and other prominent republicans. now technically a friend of the court filing is supposed to give judges more information and not act as an outside influence like a petition. but frankly they often do. yesterday we reported donald trump had written a strange tweet in support of yahoo! ceo marissa mayer reacting to news that mayer was ending work at home programs at yahoo!. trump said mayer is right in wanting women to come back in and no longer work from home. who knows what they're doing there. he has since deleted that tweet issued a new one changing the word wom to yahoo! employees.

the dow saw its worst loss since november on monday. let's check in with brian shactman this morning at cnbc world headquarters. good morning, brian. >> hey, scott. a lot of executives are chiming in on what marissa mayer did. interesting news out of yahoo! yesterday. in terms of stock futures, higher after yesterday's large sell-off triggered by the political fallout believe it or not in italy. no party was able to get a majority in elections to form a coalition government and that is ratcheting up worries about europe's ongoing debt crisis. europe markets at this hour are in the red as for us at home, we get data on home prices, new home sales and consumer confidence. the dow which came within 83 points of its all-time high yesterday closed down 216 points to 13,784. if you read after market headlines, you didn't get the whole story. it was the worst performance of the year. the dow hit a five-month high

spring. it's great. looking here toward the south bay where we have a nice smooth, easy drive as well. i don't have to remind you that it's still 5:17 coming up there. we're looking at northbound 101, 280, 87, all northbound routes good. light volume of traffic right now. we'll typically see north 101 off 680 start slowing in half an hour and traffic tuesday so i'm looking for heavily impacted morning commute for south bay as schools that it wewere off last are back today. hp pavilion sharks are playing. keep that in mind. over toward the peninsula southbound 101 and then down toward mountain view we do have road crews there. no slowing on sensors and live look out there. we'll show you southbound side has light volume of traffic with taillights away from us past university avenue. so that's the reason why there's no slowing where you lose one lane. northbound no delays. no restrictions all of the way up into san mateo. good stuff on the peninsula

side. east bay oakland 880 shows light easy traffic past high street with taillights past the construction zone and we'll end with a quick view of the east shore freeway. no delays here. we'll send it back to you. we do have breaking news that we're following this morning. a woman is dead after being hit by a car overnight and now san jose police are searching for the driver. officers say the woman was hit by a dark colored car on monterey road and bellevue avenue. the driver took off before they arrived. so far police have not released the victim's identity. our own marla tellez is headed to the scene this morning and will have a live update coming up. a cal swim coach being featured on oprah winfrey network later today sharing her story of surviving child sex abuse at the hands of a school teacher. kristen went public with her story just last year and she is suing the moraga school district claiming the district failed to

do enough to stop the abuse she was suffering through. she will be featured on "our america" starting at 10:00 p.m. a bay area congressman is calling for tougher regulations on cruise ships. he has asked for a hearing on cruise ship safety in the wake of the carnival "triumph" disaster. a fire knocked out power and left that ship adrift in the gulf of mexico for days. he wants to hear from cruise and travel companies, federal agencies and consumers trying to figure out how to prevent future mishaps. no scores, no accountability. earlier this month we exposed many silicon valley restaurants are keeping health inspection results a secret from you. the investigative unit did not stop there. now we take hidden cameras inside 50 popular restaurants all across the bay area to counties where restaurants are scored and required to post that information for all to see.

where the balloon is reported to have crashed. tourists were from hong kong, japan, britain and france. two tourists have not been identified. one egyptian and one foreigner survived but are in critical condition. in a reversal of fortune, a west sacramento police officer now behind bars this morning facing charges of sexual assault and kidnapping. police say sergio alvarez used his position to take advantage of women. they accuse alvarez of pulling women over and then assaulting them. the alleged attacks happening while alvarez was in uniform in his patrol car. investigators have identified six victims, some were attacked multiple times. >> i'm just appalled and sickened that someone who was put in a position of trust would violate that trust in such an egregious and despicable manner. >> alvarez was put on

administrative leave in september and he's now been fired from the department. he's being held at the county jail. a fixture on the morning commute is long gone. police say longtime chronicle vendor died after suffering injuries from a recent mugging. christie smith joins us with more details on the search for the attacker. good morning. >> reporter: good morning to you, laura. dallas ayers sold san francisco newspapers for at least 30 years. he was standing where we are at busy market and montgomery street. it was around 11:00 in the morning when police say that someone just threw him to the ground. he was 78 years old at the time. he was taken to a hospital here in san francisco. had stayed for several weeks in fact and suffered a serious hip injury but he later died. police are treating this as a homicide. the initial assault actually happened on january 28th and he died thursday. according to the chronicle he

worked near the montgomery b.a.r.t. station and people who knew him liked him a lot. i spoke with one vendor downstairs that say he was a quiet man and suddenly he was gone. a new person was there selling newspapers. one friend believes that the attackers may have tried to rob him because when his belongings were returned, his wallet was gong but police describe this as a battery. the suspect is described as a white male with a full beard, 35 to 40 years old, standing about 5'9", wearing a sweater and blue jeans and black shoes at the time. the actual newsstand is downstairs from where we are standing about two levels. we checked. still hasn't opened this morning. we'll see if we can find anyone that may have known him. reporting live in san francisco, christie smith, "today in the bay." now to a story you'll see only here on nbc bay area. a san jose mother right now thanking police and the community after she was robbed right in front of her children

on sunday night. sandra jimenez was walking to her apartment with two young boys when a 14-year-old boy pulled out what appeared to be real gun and stole her purse. police ultimately caught up with him an hour later. jimenez got her purse back and police decided to throw in something a little bit extra. some toys and shirts for the boys and several gift cards. >> we do this job to help people out. she's a prime example of a victim that needed help. we all got together and we made it happen. >> it feels amazing. it makes me forget about what happened and makes me feel good. >> after hearing this frightening story, a target department store donating a $100 gift card. jimenez says she's happy she and her boys are safe. >> that's good news. 5:33 right now. good news when it comes to the forecast. let's check in with

oakland. we'll catch up with folks by the coliseum. both sides picking up volume. not having a problem with speeds. holding at the limit up toward the bay bridge toll plaza. and the lights there between the north and southbound side is just construction but this is not on freeway lanes. 880 does credit construction coming down through downtown south of 980. it's still going on there for another half hour. back to you. >> we'll get a better look at plans to develop the area near at&t park today. san francisco's port commission will discuss funding for the mission rock development project this afternoon. the commission hopes to have a financial term sheet approved by april clearing the way for giants to preparing for an environmental impact report. anchor brewing company said it will be the first tenant on the development at pier 48. a sign of the economic rebound in the south bay. a project put on the shelf during the downturn now coming back to life. we're talking about the revitalization plan in san jose. bob redell is in that

neighborhood right now and he has a look ahead at how this project is moving along. bob, good morning. >> reporter: good morning, jon. for years the stay of san jose wanted to redevelop what is an eyesore here in the center of its japan town. you look at a five to six acre plot of land that is just basically a concrete patch surrounded by a chain linked fence bordered by 6th, 7th, jackson and taylor streets. it used to be home to san francisco's chinatown. chinatown disappeared and the city corporation yard eventually took its place but that too went away leaving this concrete wasteland. later today they could take steps to bring the space back to life when council members decide to approve the basic redevelopment plans for this site and give the go ahead to continue talks with the developer. that developer williams and dane development would pay the city $24 million for this parcel and on it build retail space,

now to breaking news we're following this morning. a woman is dead after being hit by a car overnight and now san jose police are searching for the driver. "today in the bay's" marla tellez is live on the scene on monterey road and bellevue avenue with more on what happened out there. good morning, marla. >> reporter: laura, good morning. you can see it's a very active scene. crime scene investigators behind us on monterey road near bellevue avenue where this all happened. you can see the crime scene markers still out here. they're picking them up doing their thing. they say a woman was crossing

the street near monterey road and bellevue avenue when she was hit by a dark colored vehicle. so far no information is being released about the driver or the woman who was killed other than this person, the driver did not stop and just kept going. now police say it happened about 1:00 this morning. you can see a look at monterey road a portion of it is shut down with plenty of police officers on scene this morning. this happened about 1:00 this morning. they responded to a report of a traffic collision. they arrived to find the woman in the street. she was taken to the hospital where she was pronounced dead less than an hour later at 1:50 this morning. again, police have very little to go on other than they are looking for a dark colored vehicle. if you have information, call san jose police. you can report tips unanimously by calling silicon valley crime

no negotiations, no compromise based on what we're hearing here in washington. nothing really in the works to stop these cuts from happening on friday. in fact, president obama is hitting the road today going to virginia to talk more about the impact of these cuts. republicans have been criticizing him saying he's campaigning instead of staying here trying to work things out. two sides are really far apart. there seems to be no good starting point especially at this late date and we are now getting a better sense of where the first cuts could hit. a lot of those who may be laid off or even furloughed may not see impact until early april. there are other things that could happen sooner like federal heating assistance in the midst of severe weather we've been having. food for new mothers may be scaled back a bit. construction money for school construction and even federally funded unemployment checks for those unemployed long te-term looking at a 10% cut in unemployment checks. we're starting to get a sense of

like to offer an itunes card to parents affected. those who got enormous bills could get cash. the court will make a decision on friday. also on friday, we hit the sequester. the markets acting very strangely. monday the dow came within reach of an all-time high even though we're days from big trouble. then right after peaking, the dow plunged more than 200 points. not because of washington but because of italy. italians had an election where very few people showed up and the election was so even not one party has a clear advantage. you have two major parties. neither with enough members to control parliament. so there's this third party run by a comedian and former yogurt pitchman. whatever way he leans is going to win. it's going to be a weak government, jon and laura. a coalition government. the concern is it won't have political will to crackdown on debt. that will drag the eurozone into a worst financial position.

good tuesday morning to you. thanks for joining us. i'm laura garcia-cannon. >> i'm jon kelley. good morning, everybody. we have a developing story to tell you about in egypt where 19 foreign tourists are dead after a fire and explosion sends a hot air balloon crashing right to the ground more than 300 miles south of cairo. that balloon was 1,000 feet up in the air when it suddenly fell into a sugar cane field. we can also tell you two survivors now remain hospitalized. among those 19 killed in that accident, tourists from france, britain, china and japan. 6:01. also new this morning, israeli police say a rocket fired into israel from the gaza strip has damaged a road. no one was injured. this is the first time a rocket fired from gaza has landed in israel since fighting along the border last november.
